Sanook Cycling Tours Terms & Conditions
- Requirements
The client should be healthy and must not suffer from an infectious disease. At the beginning of and during a group tour the guide of the group reserves the right to exclude any participant completely or partially who evidently does not comply with the requirements or disturbs the trip effectively and does not react duly to the dissuasion of the guide. In this case no claim exists for refund of the paid tour price.
Participation is open to everyone who meets the specific requirements, mentioned in the description of the journey and brings the adequate equipment (helmet, clothes, bicycle) with him or rents it after reservation. Your own bicycle has to be in an optimal technical condition. The client is responsible for maintenance, failure and repair of his own bicycle, brought with him. The wearing of a helmet is obligatory for all tours. Basically, every participant cycles at his own risk and is aware of the dangers that can arise when using a bicycle. He is alone responsible for meeting the physical requirements of the cycling journey booked.
Nevertheless, it is possible to travel with the accompanying van, if there is overstraining or sickness and the client has booked a group tour. Although the routes mainly follow fully developed bikeways, the participant should be sufficiently informed of the Thai road traffic regulations. The participation of minors is only possible in the company of an adult and with the signature of a legal guardian. - Liabilities
The traveler takes part in the trip at his own risk. Sanook Cycling is not liable for personal injury or property damage as a result of (but not limited to): physical exertion for which a guest is not prepared, forces of nature, travel by plane, train, car, boat, or other means of transport, or by bike, horse, foot or any other form of active or adventure travel, consumption of alcoholic beverages, civil unrest, terrorism, equipment failure, high altitude, lack of or limited access to medical care in remote locations and the adequacy of medical care once provided.
Sanook Cycling is also not liable for: Expenses (meals, transport, or hotel costs) that are not included in the tour price but may be necessary to get to or from a travel start or endpoint. Any liability for damage to luggage is excluded if this damage was unavoidable during carrying or lifting due to the age or condition of the piece of luggage. Should a piece of luggage be lost or damaged we are liable only, if the loss was caused by one of our employees deliberately or through gross negligence and if this loss was reported immediately after notifying us. For losses not covered by this clause, we recommend baggage insurance. This limitation of liability is also valid for carriage by external operators.
Sanook Cycling reserves the right to make route and hotel modifications as necessary to improve the trip quality or to accommodate the comfort and well-being of guests. Guests grant Sanook Cycling express permission to take photographs or make film records of its trips for promotional and commercial use, as well as approve such use by third parties with whom Sanook Cycling may engage in joint marketing, without financial remuneration.
Sanook Cycling reserves the right to amend typos and misprints in pricing and other trip information. We reserve the right to decline to accept or to retain any person as a member of a tour or to require a participant to withdraw from the journey at their expense when such an action is determined by staff to be in the best interest of the participant’s health and safety, and that of the group in general. No refund will be made for the unused portion of any tour. Sanook Cycling does not accept liability incurred by the purchase of a non-refundable airline ticket - Registration and Confirmation
Booking a Sanook Cycling tour commences when you complete our online booking form. It is necessary for you to complete this form, in order to proceed with your booking. Participation in one of our tours is only valid once we have received the booking form. The first named client must be over 18 years of age. A booking is accepted and becomes definite only from the date when the company sends a confirmation. It is at this point that a contract between the company and the client comes into existence. Payment of your deposit, and selecting that you have read these booking conditions, equates to agreeing to the terms of services and stipulations as indicated below. Please read the booking form completely before initiating a deposit and contact us, if you require further clarifications of any of the following conditions. - Payments
We require an immediate deposit of 25% to confirm your booking. The remaining balance of the package cost must be paid 45 days prior to the departure date. Bookings made less than 45 days before the tour start date will require full payment once a booking is confirmed. The tour price must be paid in full before participation in a tour. No person(s) will be allowed to join a tour without fully settling their invoice and receiving a confirmation from us.
Payment options:
Credit card: Our credit card provider charges 5.5% fees. We pass these costs on to you.
Bank Account: You may pay to our Thai Business Account mentioned in the check-out process
Revolut/Wise Bank Accounts: Optionally you may pay us via Revolut or Wise. Instructions will be given after we receive your booking. - Change of reservation
There is no legal right to make changes with respect to the date of the journey and the destination after concluding the contract. If changes of reservation are possible and Sanook Cycling agrees to them, a single service charge of THB 1,500 per person is due. You can transfer your booking to another person up to 14 days before departure. You have to alert us to this change in writing. The substitute person has to fulfill the terms and further prerequisites connected with the participation of the journey, whereas both (substitute person and forwarding person) are liable jointly and severally to pay for the balanced price and arisen additional costs. Such additional costs can be, for example, no more possible double room occupancy. - Delays of flights
We will not accept any liability for any delay in your flights, whether the cancellation or delay is caused by the weather, airline rescheduling, industrial action, or mechanical failure. We will give no refunds or compensation for lost time and services from the itinerary. - Withdrawal by guests
Cancellation charges will be imposed as a percentage of the total package price as follow:– Anytime to 30 days before departure [100% – X]
You will receive an amount of 100% package price subtracted by an accrued amount of actual costs (third parties booking fee, transport booking fee, hotel booking fee, any amount that occurred toward your benefit for booking) Provided with receipt(s). Any payment gateway or bank transfer fees will not refunded.
– 15 to 29 days before departure [50% – X]
You will receive an amount of 50% package price subtracted by an accrued amount of actual costs (third parties booking fee, transport booking fee, hotel booking fee, any amount that occurred toward your benefit for booking) Provided with receipt(s). Any payment gateway or bank transfer fees will not refunded.
– 0 to 14 days before departure: no refund.
- Cancellation due to extraordinary circumstances
If the journey is substantially complicated, endangered, or compromised due to circumstances we are not responsible for – war, strike, riots, epidemics, mandatory regulations, and the like – both parties can withdraw from the contract or respectively cancel it. This is also valid if journeys cannot be commenced or have to be canceled due to external circumstances (extreme weather, returning because of an injured participant or the tour guide, etc.). Additional costs for a potential return journey are at your expense. Of course, we will refund the price paid for the tour less a service charge. Exceptions to this policy cannot be made for any reason, including weather or personal emergencies. Sanook Cycling is not responsible for expenses incurred in preparation for any canceled trips, such as airline tickets. We regret that we cannot be held responsible for incidental/consequential costs or expenses you may incur as a result of any changes or cancellations. No compensation is payable for minor changes. Any damages/injuries incurred that are attributable to your own actions, acts of some other party unconnected with the contract services, or where the damage/injury results from events/circumstances which are outside our control and could not be reasonably foreseen. For damages where Sanook Cycling is responsible, our liability is strictly limited to twice the total price of the tour. In booking a tour with Sanook Cycling you, the client, are agreeing to these terms and you accept this limit on our liability. - Trip Cancellation by Sanook Cycling
On the rare occasions when we must cancel a trip, all payments received to date will be 100% refunded. - Liability for rented bikes and equipment
Any loss or damage to bikes, and other tour equipment, resulting from improper use and/or failure to follow instructions with regards to safety and operation, will be charged to the customer to the equivalent value of the repair or replacement costs. - Helmets
It is required that a bicycle helmet be worn by all cyclists. Failure to wear a helmet will result in the customer not being allowed to cycle as a part of the tour program.
